Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you and Axiomic, LLC, a California limited liability company (“Axiomic,” “we,” “us,” or “our”), the owner and operator of the Ask Nonna mobile application and website (“App” or “Service”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

These Terms should be read in conjunction with our Privacy Policy, which governs our data practices.

1. Definitions

• “Service” refers to the Ask Nonna mobile application, website at asknonna.app, and all related features, tools, and services.
• “Content” refers to any information, text, images, or other materials submitted to or displayed through the Service.
• “User Content” refers to Content you submit, including food label images, votes, comments, corrections, and alternative suggestions.
• “Community Knowledge Base” refers to the public database of food products, ingredients, producers, and verdicts built from user scans.
• “Verdict” refers to the AI-generated assessment of a food product's ingredient list.

2. Eligibility

You must be at least 13 years of age to use the App. If you are between 13 and 18, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

3. Description of Service

Ask Nonna is a free, AI-powered food ingredient analyzer. The App allows you to:

• Photograph food product ingredient labels using your device camera.
• Passively detect product barcodes (UPC/EAN) via the camera to identify products and enable instant cached results for previously scanned items.
• Submit images for analysis by artificial intelligence that evaluates ingredients against a “clean label” philosophy inspired by a 1950s Italian grandmother's kitchen.
• Receive a Verdict categorizing the product as Approvato (real food) or Mamma Mia (fake food).
• Store and review your scan history in a personal pantry.
• Contribute to a Community Knowledge Base of food products, ingredients, and producers.
• Vote on verdict accuracy, suggest corrections, and recommend alternatives.
• Share verdict results via social media or messaging platforms.

4. Account Registration

You must sign in with Apple to use the App. You are responsible for maintaining the security of your Apple ID and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

5. Community Data & User Content

When you scan a product, the ingredient analysis and product information are contributed to the Community Knowledge Base. This data powers the Nonna Approves website, ingredient pages, and producer pages.

Product data (product name, producer, ingredients, verdict, label image) is community knowledge. You grant Ask Nonna a non-exclusive, worldwide, royalty-free, perpetual license to display, distribute, and use this data for operating the Service and Community Knowledge Base. This data remains in the knowledge base even if you delete your account. Upon deletion, your identity is removed from all contributed data (see Privacy Policy).

Votes, comments, corrections, and alternative suggestions are associated with your account. You retain ownership of your submitted content. These will be deleted if you delete your account.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Submit images unrelated to food ingredient analysis.
• Submit spam, abusive, harassing, or illegal content in comments, corrections, display names, or profile bios.
• Impersonate another person or misrepresent your affiliation with any person, organization, or brand.
• Manipulate votes, ratings, or community features.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Use automated means to access the Service without permission.
• Circumvent technical measures, rate limits, or security controls.

You may report inappropriate content or behavior using the in-app Report feature on any user's public profile, and you may block other users from appearing in your feeds. Reports are reviewed and acted on at our discretion. We may remove content or suspend accounts that violate these Terms.

7. Intellectual Property

The App, including its design, code, branding, graphics, AI prompts, and verdict system, is owned by Ask Nonna and protected by United States copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, solely for personal, non-commercial purposes. This license terminates automatically if you violate these Terms.

“Ask Nonna,” the Ask Nonna logo, and all related names, logos, and slogans are trademarks of Ask Nonna.

Company names, logos, and trademarks appearing on scanned product labels are the property of their respective owners and do not imply endorsement of or affiliation with Ask Nonna.

If you believe content on the Service infringes your copyright, contact [email protected] with identification of the copyrighted work and the allegedly infringing content.

8. Artificial Intelligence Disclosure

The App uses the following AI and automated processing:

• Google Gemini 2.5 Flash — Analyzes food label images and generates ingredient verdicts. Only food label images are sent; no personal information is transmitted to Google's AI.
• Google Cloud Vision SafeSearch — Screens uploaded images for inappropriate content before storage.
• Barcode Detection — The camera passively reads UPC/EAN barcodes using on-device processing (Apple AVFoundation). No barcode data is sent to third parties; barcodes are used only to look up products in our own database.

AI-generated verdicts may be inaccurate, incomplete, or inconsistent. Verdicts are for informational and entertainment purposes only. They do not constitute medical advice, nutritional counseling, or dietary recommendations.

We do not use your personal data, submitted images, or any content you provide for training artificial intelligence or machine learning models.

9. Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes our data collection, use, and sharing practices, including your rights under the CCPA, GDPR, and other applicable privacy laws.

10. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms. While we work to ensure Service availability, we cannot guarantee uninterrupted access if these providers experience issues.

11. Service Availability

We strive to provide uninterrupted service but do not guarantee the App will be available at all times. We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice.

12. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, either express or implied. Ask Nonna disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

The App provides AI-generated assessments for informational and entertainment purposes only. Verdicts are not medical advice, nutritional counseling, allergy guidance, or dietary recommendations. The App does not diagnose allergies, intolerances, or health conditions. Always consult a qualified healthcare professional before making dietary decisions.

The AI may be inaccurate. We do not guarantee the accuracy, completeness, or reliability of any analysis or verdict.

13. Limitation of Liability

To the maximum extent permitted by law, Ask Nonna shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or business interruption.

In no event shall our total liability exceed the greater of (a) fifty dollars ($50.00) or (b) the amount you paid us in the twelve months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ask Nonna and its operators from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that arise from or relate to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

15. Termination & Account Deletion

Termination by you:You may delete your account at any time using the “Delete Account” button in the App's Settings screen.

Termination by us: We may suspend or terminate your access to the App immediately, without prior notice or liability, for any reason, including violation of these Terms.

Upon account deletion:

• Your profile, votes, comments, corrections, scan history, and authentication account are permanently deleted from our servers.
• Product data you contributed (product name, ingredients, verdict, label image) remains in the Community Knowledge Base in anonymized form.
• Your local scan history is cleared from your device.

16. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures. The arbitration shall take place in Marin County, California. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class action waiver: You and Ask Nonna agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Jury trial waiver: To the extent permitted by law, you and Ask Nonna each waive the right to a jury trial in any court proceeding arising out of or related to these Terms.

Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent infringement of intellectual property rights.

If you are a consumer residing in the European Union, the binding arbitration provisions do not apply to you. You may bring proceedings in the courts of your country of residence.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Subject to the arbitration provisions above, you submit to the exclusive jurisdiction of the state and federal courts located in Marin County, California.

18. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App at least 30 days before the changes take effect. Your continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the App.

19. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ask Nonna regarding the Service.

Severability: If any provision is found unenforceable, that provision will be limited to the minimum extent necessary, and the remaining provisions remain in full effect.

Waiver: No waiver of any provision shall constitute a further or continuing waiver. Our failure to assert any right shall not constitute a waiver of such right.

Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

Force Majeure: Ask Nonna will not be liable for any failure or delay resulting from causes beyond its reasonable control, including acts of God, natural disasters, pandemic, war, government action, or internet service provider failures.
